ORDINANCE NO. 2006-15 BE IT ENACTED BY THE QUORUM COURT OF THE COUNTY OF LONOKE, STATE OF ARKANSAS, AN EMERGENCY ORDINANCE TO BE ENTITLED:
“AN ORDINANCE TO AMEND LONOKE COUNTY ORDINANCE 1978-26 TO CLARIFY THAT THE LONOKE COUNTY LIBRARY BOARD IS ESTABLISHED AND OPERATES UNDER THE AUTHORITY OF A.C.A. 14-14-705; AND FOR OTHER PURPOSES.” WHEREAS, Arkansas Code Annotated Sec. 14-14-705, as regards county library boards, was amended in 1997; and
WHEREAS, it has been discovered during routine research that such change in the Arkansas Code Annotated is apparently mission or was not addressed by the Quorum Court in 1997; and WHEREAS, this over sight being brought to the attention of the Quorum Court should be corrected to reflect the current law and current mode of operation of the Lonoke County Library Board. NOW THEREFORE BE IT ENACTED, that Lonoke County Ordinance 1978-26 is hereby amended to read as follows:
Section 1. The Lonoke County Library Board established by Ordinance 1978-26 is hereby terminated effective upon passage of this ordinance.
Section 2. Upon the passage of this ordinance and effective immediately the Lonoke County Library Board is created as authorized by Arkansas Code Annotated 14-14-705 and may exercise all rights and powers pertinent thereto.
Section 3. Upon the passage of this ordinance and effective immediately the Lonoke County Library Board shall consist of those members currently holding office with such members rotating off the Board in such fashion as provided for by A.C.A. 14-14-705.
Section 4. All actions, agreements, contracts and etc. entered into by the Lonoke County Library Board as established by Ordinance 1978-26, up to the effective date of this ordinance, are hereby ratified by the Lonoke County Quorum Court.
Section 5. The Lonoke County Clerk shall maintain a register, if not already being kept, of future Lonoke County Library Board appointments as required by 14-14-705 et seq.
Section 6. All ordinances or parts thereof in conflict herewith are herby repealed to the extent of such conflict.
Section 7. If any provision of this ordinance or the application thereof to any person or circumstance is held to be invalid, such invalidity shall not affect other provisions or application of the ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are declared severable.
Section 8. This ordinance being necessary from the protection and preservation of the public health and safety an emergency is hereby declared to exist and this Ordinance shall be in full force and shall take effect upon passage.

ORDINANCE NO. 2006-14
BE IT ENACTED BY THE QUORUM COURT OF THE COUNTY OF LONOKE, STATE OF ARKANSAS AN EMERGENCY ORDINANCE TO BE ENTITLED: “AN ORDINANCE AUTHORIZING THE BORROWING OF $272,941.30 AND EXECUTION OF A PROMISSORY NOTE TO THE FIRST STATE BANK FOR THE PURPOSE OF PAYING OFF THE THREE REMAINING OF SIX MACK TRUCKS WITH HILBILT DUMP BEDS PURCHASED IN 2005; AND PRESCRIBING OTHER MATTERS PERTAINING THERETO.”
ARTICLE 1. Authorization to borrow the sum of $272,941.30 from FIRST STATE BANK is hereby approved for the LONOKE COUNTY ROAD DEPARTMENT for the purpose of renewing Loan #150291; originally used to purchase six dump trucks with Hilbilt beds in calendar year 2005. The proceeds of such loan shall be used to payoff the balance still owed by Lonoke County for the purchase of said equipment.
ARTICLE 2. Under the authority of Amendment 78 to the Arkansas Constitution and Act No. 1808 of 2001, LONOKE COUNTY shall borrow from FIRST STATE BANK the sum of $272,941.30 for the purchase price of the equipment at a rate of 8.25% per annum, and the County Judge is authorized and directed to execute a Promissory Note to the FIRST STATE BANK for $272,941.30, together with interest rate of 8.25% per annum with interest due quarterly beginning October 21, 2006 and with the final payment of all interest and principal due on July 21, 2007.
ARTICLE 3. (a) As provided in Amendment No. 78, the annual debt service payments on the Promissory Note in each fiscal year shall be charged against and paid from the road revenues of the County for such fiscal year. For the purpose of making the debt service payment, there is hereby, and shall be appropriated to pay the Promissory Note, an amount of road revenues of the County sufficient for such purposes. The County covenants with FIRST STATE BANK that it shall not take any action or suffer or permit any action to be taken or condition to exist which causes or may cause the interest payable on the Promissory Note to be included in gross income for federal income tax purposes. (b) The Promissory Note is hereby designated as a “qualified tax-exempt obligation” within the meaning of Section 265(b) of the Internal Revenue Code of 1986 as amended.
Article 4. The Promissory Note shall be secured by a lien on and security interest in the equipment and in order this evidence the lien, the County Judge is hereby authorized to execute and deliver to FIRST STATE BANK a security agreement (the “Security Agreement”).
ARTICLE 5. The County Judge and County Clerk, for and on behalf of the County, are hereby authorized and directed to do any and all things necessary to effect the execution and delivery of the Security Agreement and the performance of all obligations of the County there under, the tax-exempt status of interest on the Promissory Note, and the performance of all acts of whatever nature necessary to effect and carry out the authority conferred by this Ordinance. The County Judge and County Clerk are hereby further authorized and directed, for and on behalf of the County, to execute all papers, documents, agreements, certificates and other instruments that may be required for the carrying out such authority or to evidence the exercise thereof.
